Nomadic Fire Mobile Sauna LLC Liability Waiver

This Liability Waiver (hereinafter the “Agreement”) is made and entered into on

by and between

(hereinafter “you”) and Nomadic Fire Mobile Sauna LLC, with a mailing address of 12650 West 64th Ave Unit E-300 Arvada, CO 80004 (hereinafter “Nomadic Fire Mobile Sauna”). This Agreement applies to your use of the sauna and all other activities (“Activities”) offered by Nomadic Fire Mobile Sauna. 

You agree and acknowledge that you may not participate in any Activities if you have any physical or medical condition that inhibits your ability to adapt to extreme temperatures. If you have heart disease, are pregnant, have breathing issues, anhidrosis or any other medical condition, you may only participate in an Activity with permission from your medical provider and Nomadic Fire Mobile Sauna. Further, you agree and acknowledge that if you are pregnant, your use of the sauna is at your own risk and you release Nomadic Fire Mobile Sauna from any liability if you use the sauna and are pregnant.

By participating in the Activities offered at Nomadic Fire Mobile Sauna, you agree and acknowledge that participation in such Activity naturally involves risk of injury, whether you or someone else causes it. Specific risks vary and the risks range from minor injuries to major injuries, including catastrophic injuries up to death. The typical injuries that may occur include injuries due to slipping on slippery surfaces caused by water, ice, steam, or other substances; medical issues due to exposure to extreme temperatures; burns from exposure to hot equipment; and suffering from burns, bruises, increased body temperature, increased heart rate, muscle strains, and other injuries received due to participating in an activity with extreme temperature changes. In addition, due to the nature of the Activities, you may also be exposed to airborne illnesses and transmittable diseases, and other naturally occurring issues. In consideration of your participation in the Activities offered by Nomadic Fire Mobile Sauna, you understand and voluntary accept this risk and agree that Nomadic Fire Mobile Sauna, its owners, directors, employees, volunteers, agents, and independent contractors will not be liable for any injury, including, without limitation, personal, bodily, or mental injury, economic loss or any damage to you resulting from any action of Nomadic Fire Mobile Sauna, including, but not limited to, the negligence of Nomadic Fire Mobile Sauna, anyone on Nomadic Fire Mobile Sauna’s behalf, and/or anyone participating in the Activity.

You agree and acknowledge that you on behalf of yourself and your personal representatives, executors, administrators, heirs or next of kin, that you waive, release, discharge, agree to hold harmless, and covenant not to sue Nomadic Fire Mobile Sauna, and its owners, shareholders, members, partners, employees, officers, directors, agents, and other affiliated persons or entities from any and all liability for any death, personal injury, damage to personal property, loss of personal property, costs, expenses, attorney’s fees, actions, causes of action, suits, obligations, judgments and claims of any nature that you sustain in connection with my participation in the Activities.

You agree, understand, and acknowledge that Nomadic Fire Mobile Sauna provides recreational services and may not be held liable for defective products. Should you be injured in any way due to a defective product, your only recourse if with the manufacturer.

You agree and acknowledge that Nomadic Fire Mobile Sauna has certain safety procedures that you must follow. This includes that you cannot participate in any Activity if you are impaired by alcohol, illegal drugs, medications (including medical marijuana), or any other substance that may lead to your ability to adapt to a hot and/or cold environment.  Should you violate any rules or directives of Nomadic Fire Mobile Sauna or fail to follow the safety procedures, you may be asked to leave the premises, and no refund will be given.

You agree and acknowledge that you indemnify and agree to hold harmless the Nomadic Fire Mobile Sauna and its owners, shareholders, members, partners, employees, officers, directors, agents, and other affiliated persons or entities from any and all liability for any death, personal injury, damage to personal property, loss of personal property, costs, expenses, attorney’s fees, actions, causes of action, suits, obligations, judgments and claims of any nature arising from, or in connection with, any actions that you take while participating in an Activity in which you harm or injury a third party in any way.

You agree and understand that there is no right to privacy in the public areas of Nomadic Fire Mobile Sauna. Further, you agree and acknowledge that both video and photographs may be taken at Nomadic Fire Mobile Sauna in public areas for marketing purposes and agree and acknowledge that you have granted Nomadic Fire Mobile Sauna the rights to use such video and photographs.

This waiver shall be interpreted according to the laws of Colorado. You agree to be subject to the personal jurisdiction of the District Court for the Boulder County, Colorado with respect to this waiver.
